New Jersey Bans Asbestos-Containing Products

The US state of New Jersey has prohibited asbestos in all products. The new law will become effective on September 1, 2019.

The US state of New Jersey has banned asbestos-containing products. The governor signed bill A4416 into law on May 10, 2019, banning both sale and distribution.

Under the terms of the law, the state’s Department of Environmental Protection (DEP) must establish a public education program concerning the ban on asbestos-containing products. The department is also given new powers to enter retail establishments to determine compliance with the law.

Title 34 - “Labor and Workmen’s Compensation’ - Chapter 5A-34 defines asbestos as asbestiform varieties of actinolite, amosite (cummuningtonitegrunerite), anthophyllite, chrysotile (serpentine), crocidolite (riebeckite) and tremolite. The law prohibits each of these substances, effective September 1, 2019.

A study from 2015 by the Environmental Working Group (EWG) Action Fund found asbestos in children’s crayons and toy crime lab kits. It was most likely to be a contaminant in talc, which is used as a binding agent in these products.

Stakeholders are advised to now check their products comply with New Jersey’s new law for asbestos-containing products.
