The European Commission (EC) has introduced a prohibition on the use of extracts and oils from the Tagetes erecta flower in cosmetic products. Concurrently, the EC is also seeking to restrict the use of extracts and oils from Tagetes minuta and patula in cosmetic products.
Not previously included in Cosmetics Regulation (EC) 1223/2009, these fragrance compounds are widely used in the cosmetics industry. However, following the opinion 0869/05 of the Scientific Community on Consumer Products (SCCP), the use of Tagetes erecta flower extract and oil has been prohibited in cosmetic products as they represent a potential risk to human health.
In addition, the EC, following SCCP opinion 0869/05, has also issued a restriction on the use of extracts and oils from Tagetes minuta and Tagetes patula. The restrictions are:
• Leave-on cosmetics – maximum concentration of 0.01%
• Rinse-off cosmetics – maximum concentration of 0.1%
The restrictions also require the maximum content of alpha terthienyl (terthiophene) in the extracts or oils shall not exceed 0.35 %.
These ingredients are prohibited for use in sunscreen products and products marketed for exposure to natural/artificial UV light.
The amendment to Commission Regulation (EU) 2018/978 came into force on July 29, 2018. The new regulations mean:
• From May 1, 2019 – cosmetic products containing these substances cannot be place on the market in the EU
• From August 1, 2019 – cosmetic products containing these substances must not be made available in the EU
Stakeholders are advised to make sure their products are now compliant with the latest cosmetic regulations covering access to the EU market. It is also advised that products containing Tagetes minuta and patula extracts and oils should be double-checked for usage level and purity.
